Fire Risk Assessment for hotels and commercial premises in North Wales.

The Law States:-

The responsible person must make a suitable and sufficient assessment of the risks to which relevant persons are exposed for the purpose of identifying the general fire precautions he/she needs to take to comply with the requirements of the Order.

Meaning of
"responsible person"

In relation to a workplace, the employer, if the workplace is to any extent under his/her control; Or the person who has control of the premises (as occupier or otherwise) in connection with the carrying on by him/her of a trade, business or other undertaking (for profit or not).

The Order also makes clear

That he/she is not just responsible for employees on there premises but also for any other person that is lawfully there, including customers, visitors and contractors.

From 1st October 2006, the two major pieces of fire safety legislation the Fire Precautions Act 1971 and the Fire Precautions (Workplace) Regulations 1997 as amended have been repealed and replaced by the Regulatory Reform Order 2005. It also consolidates the fire safety provisions of other legislation under one simple set of goal based requirements.

This legislation covers virtually every type of building, structure and open space, except for private homes and individual flats in a block or house, although communal areas will be affected. This means that the person responsible (known as the responsible person) for any work place, (usually owner/occupier/employer) must undertake a fire risk assessment.

If there are 5 or more persons employed in the premises then that risk assessment must also be recorded in writing, and available for inspection as required.
